Welcome to Nail Ritual! The terms “we”, “us” and “our” refer to Nail Ritual. We operate this shop and this website to offer you, our customer, a special shopping experience (the “Service”).

Please read these General Terms and Conditions (the “GTC”) carefully. They govern your rights and obligations when using our Service.

SECTION 1 – USE OF THE SHOP

By agreeing to these GTC, you confirm that you are of legal age in your country of residence.

To shop with us, you will be asked to provide certain information (e.g. email address, billing and shipping address). You confirm that all information you provide is accurate and complete. You are solely responsible for the security of your customer account and for all activities carried out through it.

SECTION 2 – OUR PRODUCTS

We make every effort to present our products as accurately as possible. Please note that colour representation may vary depending on your screen settings. Product descriptions and prices are subject to change. We reserve the right to remove products from our range at any time.

SECTION 3 – ORDERS & CONCLUSION OF CONTRACT

When you place an order, you are making us an offer to purchase. The purchase contract is concluded as soon as you receive an order confirmation from us by email. We reserve the right to decline orders at our sole discretion.

Please check your order carefully. Once the contract has been concluded, cancellations are only possible to a limited extent.

The return or exchange of products is governed exclusively by our [Return Policy] (INSERT LINK). You confirm that you are purchasing our products for personal use and not for commercial resale.

SECTION 4 – PRICES AND PAYMENT

All prices shown are final prices in Swiss francs (CHF). As a small business, Nail Ritual is not subject to VAT, which is why no VAT is shown.

Any shipping costs will be shown separately during checkout and added to your total. Offers and discounts are time-limited. The price applicable to your order is the one displayed at the time of ordering and stated in your order confirmation.

You agree to provide current and accurate payment and account information for all purchases made with us.

SECTION 5 – SHIPPING

All stated delivery times are estimates. Once we have handed the goods over to the shipping service provider, the risk of loss or damage passes to you.

SECTION 6 – INTERNATIONAL ORDERS (OUTSIDE SWITZERLAND) For deliveries to countries outside Switzerland, additional costs may be incurred for which we are not responsible and which must be borne by you as the customer.

These include, for example, costs for money transfers by credit institutions (e.g. bank transfer fees, exchange rate fees) or import-related charges or taxes (e.g. customs duties, import VAT of the respective country). As the importer, you are responsible for the proper customs clearance and taxation of the products in your country.

SECTION 7 – INTELLECTUAL PROPERTY

All content on this website, including texts, graphics, logos, images and the “Nail Ritual” brand itself, is our property or that of our licensors and is protected by Swiss and international copyright laws. Any use or reproduction without our express written consent is not permitted.

SECTION 8 – RELATIONSHIP TO SHOPIFY

Our shop is hosted on the platform of Shopify Inc. However, the purchase contract for products is concluded directly between you and Nail Ritual.

SECTION 9 – DATA PROTECTION

SECTION 10 – WARRANTY

We strive to provide you with flawless, high-quality products. Should a product nevertheless be defective, the statutory warranty provisions of the Swiss Code of Obligations apply. Please inspect the goods upon receipt and report any defects to us in accordance with the instructions in our Return Policy. Any further warranty is excluded to the extent permitted by law.

SECTION 11 – LIMITATION OF LIABILITY

Nail Ritual is liable only for direct damages caused by intent or gross negligence. Any liability for slight negligence as well as for indirect or consequential damages is fully excluded to the extent permitted by law.

SECTION 12 – SEVERABILITY

Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall not be affected.

SECTION 13 – APPLICABLE LAW AND PLACE OF JURISDICTION

These GTC and all contracts concluded via this shop are governed exclusively by Swiss law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction is the registered office of Nail Ritual (Rapperswil-Jona, Switzerland).

SECTION 14 – AMENDMENTS TO THE GTC

We reserve the right to amend these GTC at any time. The current and binding version is published on our website.
